The River Gallery Apartments’ By Laws
The River Gallery’s By-Laws set out a series of Rules which govern Owners, Residents and Visitors activities. The River Gallery Body Corporate Committee administer these By Laws and is required, by Law, to act reasonably in doing so.
Owners, Residents and Visitors are expected to respect these By Laws.
A Body Corporate is able to legally enforce compliance with its By Laws where any Owner, Resident, Occupier or Guest persistently contravenes a By Law.
Body Corporates are required, by law, to provide residents with access to The River Gallery’s By Laws.
Breaching By Laws
Occasionally Owners, Residents or Visitors may knowingly or unknowingly breach a specific By Law. Either way, it’s a Breach of TRG’s By Laws.
When that happens the Body Corporate Committee will take the following steps:
- Seek an amicable, informal solution with an informal warning given to the Offender.
- If the informal approach fails or there is a repeat of the By Law Breach, the Body Corporate Committee may issue the Offender with a formal By Law Breach Notice requiring compliance with the By Law.
- If the Offender requires time to rectify a By Law Breach (e.g. having to repaint a balcony in the correct colour) the Body Corporate Committee may issue a Future By Law Breach Notice which stipulates the time period to rectify the By Law Breach.
- If an Offender ignores the By Law Breach Notice and continues to breach that By Law then the Body Corporate Committee may resolve to refer the matter to a Magistrate for resolution.
- Magistrates are empowered to impose substantial Fines for the continuing By Law Breaches.
